BSCI Code of Conduct


1. It is recommended that the members of the Business Compliance Organization (BSCI) are composed of retail companies and associations, importers and production companies. It is a universal monitoring system for compliance with social responsibilities in European society, and aims to continuously improve the production and production of members in all parts of the world. The social responsibility performance of the supply facility. The BSCI monitoring system is not intended to replace other established external multi-stakeholder confirmation systems.


2. BSCI members believe that they need to be responsible for all global activities under their name. They especially feel obligated to provide good working conditions for the employees who produce their products. BSCI members also believe that this responsibility should extend to all employees who produce for BSCI members, regardless of whether they are employees directly employed by BSCI members or employees employed by third-party subcontractors and suppliers.


3. In order to have a certain impact and promote socially acceptable production conditions, BSCI members formulated this "Code of Conduct". All suppliers of BSCI members in the world are also obliged to abide by this Code of Conduct.


BSCI members should implement the Code of Conduct in an active and cooperative spirit. They are happy to fully comply with the Code while maintaining all existing business relationships. BSCI plans to increase awareness of this issue in the near future and achieve continuous and sustainable improvements in the next few years. Improvements in compliance with social responsibilities will enable suppliers to meet current and future market needs and legal requirements. Suppliers’ performance in social responsibility can be systematically improved over time and can avoid the crisis of resistance. BSCI's position is that only when the basic living standards are maintained and improved can the economy develop sustainably and society can progress.


4. The "Code of Conduct" only describes lower standards. The Code should not be interpreted as a larger limit, and it should not be used to disadvantage employees in any way, for example, to restrict employees' freedom of association or the right to collective bargaining.


5. BSCI members believe that they are cooperating with suppliers in a partnership. The implementation of socially acceptable production conditions is based on the principles of dialogue, consensus, cooperation and fairness. The interests of related parties that are significantly affected by the changes should be placed in a prominent position for any consideration and changes. The implementation and implementation of the Code of Conduct depends on the development of the respective suppliers and the countries in which they operate. The ultimate goal of BSCI is to fully implement the code.


6. The supplier must ensure that all subcontractors involved in the production process (such as preparation and assembly activities) representing the members of the BSCI through the production phase comply with the Code of Conduct.


7. According to the International Labor Organization Conventions, the United Nations "Universal Declaration of Human Rights" and the United Nations Convention on the Rights of Children and the Elimination of All Forms of Discrimination against Women, BSCI's "Code of Conduct" is committed to achieving certain social responsibility and environmental standards. The following requirements are of special importance.


7.1 Compliance with the law: Comply with all applicable national laws and regulations, lower standards in the industry, International Labor Organization and United Nations conventions, and any more stringent related regulations.


7.2 Freedom of association and the right to collective bargaining


7.3 Under certain circumstances or where the country’s freedom of association and collective bargaining rights are restricted due to legal regulations, autonomous and free organization and negotiation should be promoted in a similar manner. This is in accordance with the provisions of Articles 87, 98 and 135 of the International Labour Organization Convention.


7.4 Prohibition of discrimination: there shall be no discrimination against gender, age, religious belief, ancestry, social status, social background, disability, race and ethnic origin, nationality, membership in workers' organizations, including trade unions, party affiliation, sexual orientation, or any other individual Characteristic discrimination. This is in accordance with the provisions of Articles 100 and 111 of the International Labour Organization Convention.


7.5 Compensation: The payment of normal working hours wages, overtime wages and overtime wages should meet or exceed the lower legal standards and/or industry standards. Do not lower workers’ wages illegally or without permission. If the statutory lower wages cannot cover daily expenses and provide additional disposable income, the company should strive to provide employees with sufficient compensation to meet this part of the need. This is in accordance with the provisions of Articles 26 and 131 of the International Labour Organization Convention.


7.6 Working hours: Overtime work should be done on a voluntary basis. The allowable working time per week is a long 48 hours, and the allowable overtime is a long 12 hours. Employees are entitled to one day off after working for 6 consecutive days. This is in accordance with the provisions of Articles 1 and 14 of the International Labour Organization Convention.


7.7 Workplace safety: A set of regulations and procedures on occupational health and safety must be clearly established and strictly implemented. The practices and conditions of the workplace must not compromise basic human rights. This is in accordance with Article 155 of the International Labour Organization Convention and Article 164 of the International Labour Organization’s recommended standards.


7.8 Prohibition of child labor: In accordance with the International Labor Organization and United Nations conventions and/or national laws, child labor is prohibited. Among these standards, the stricter one should be referred to. Exploitation of children in any form is also prohibited. No working conditions that are like slaves or harmful to children’s health are not allowed. The rights of minor workers must be protected. This is in accordance with the provisions of Articles 79, 138, 142 and 182 of the International Labour Organization Convention.


7.9 Prohibition of forced labor: any form of forced labor is prohibited, such as prisoner-style labor that violates basic human rights. This is in accordance with the provisions of Articles 29 and 105 of the International Labour Organization Convention.


7.10 Environmental and safety issues: The procedures and standards for waste management, the treatment and removal of chemicals and other hazardous materials, and the treatment of emissions and effluents must all meet or exceed lower legal requirements.


8. BSCI members will encourage compliance with the above requirements, define and implement appropriate procedures and monitor the compliance of their suppliers.


9. Once it is determined that the "Code of Conduct" is violated, BSCI members will immediately negotiate with the relevant suppliers. They will discuss solutions together, and BSCI members will assist in solving the problem. The solution must take into account the better interests of employees. If the unanimously agreed suitable plan cannot be found within an appropriate time and implemented, this can be a reasonable reason for terminating further business dealings.


10. Any actions of BSCI and its members will not reduce the responsibility of national and local governments, international non-governmental organizations and employee representatives in establishing open market trade policies and ensuring that social conditions are improved.


11. BSCI intends to submit the main content of this statement to public deliberations and political resolutions.

5BSCI review application conditions


The conditions that must be met to apply for the BSCI review application.

3. Description of the audit


BSCI audits can only be conducted by auditing companies and auditors approved by SAI, and BSCI reports are valid for three years.


Before accepting the audit, the supplier should submit the existing audit report and certificate to the audit company. If you submit a valid SA8000 certification related to the scope of BSCI or a certificate with equivalent recognition, you do not need to conduct any audit measures again. If the supplier is currently undergoing SA8000 certification or certification of similar standards, the same applies.


Audit principle: The audit is conducted in accordance with the regulations in the BSCI management manual and audit guidelines. The purpose of the audit is to assist the supplier to improve its social standards. In order to ensure consistent application of BSCI goals and principles, BSCI audit questionnaires must be used in all audit processes.


Who are the members of BSCI?


BSCI members are the company as a full member with voting rights in the general meeting or the association as a related member without voting rights. Members can be retailers, factories, importers and public trading departments from various sectors and countries. BSCI is open to European Union and non-European Union companies.


What products does BSCI cover?


Audits including BSCI can be conducted at any production plant in the world.


The types of items broadly cover different scopes of BSCI. There are a large number of department stores that sell various textiles, clothes, home textiles, small devices, toys, and accessories as members. There are also members who focus on a particular product group, such as clothing stores, shoe retailers, baby products or sports products. Does BSCI provide certificates?

It is not a certification system, so certificates cannot be issued. BSCI provides a consistent management tool for members, suppliers, auditors, and qualified people in a specific process. This method ensures a consistent review process and evaluation, so the results are comparable.


If I have not obtained the certificate, how can I receive the audit certificate? The cover of the audit report lists the results, and the validity period of the audit can be displayed on the factory unit and used as an audit certificate.


The cost of an audit?


The cost of the audit depends on the size of the scale, the location of the factory, and the number of working days required for the audit.


For example, the audit time policy requires at least one working day (8 hours) at the site of a small business (less than 250 employees). The price is directly proportional to the company and the country.


Who pays for the audit?


This is negotiated between BSCI members and its suppliers. There is no fixed convention in BSCI.


How long is the validity period of BSCI?


The validity period of BSCI is 3 years.


Which auditor conducts the audit?


Today, only independent audit companies recognized by SAI and selected by BSCI will be entrusted to perform BSCI social audits. This guarantees a better possible audit quality and avoids costly and bureaucratic certification processes. BSCI is not a certification scheme, but a supervision system that uses SA8000 as a regulation.
